Our store is hosted on WIX Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

You may use the content of the website for the limited purpose of exploring the site or placing an order. None our content may be distributed, reproduced, downloaded, republished, transmitted, altered, posted or copied without our prior written consent from Jour Couture.

Jour Couture does not own, create, design, recreate, copyright, or trademark any team logos and designs. All team jerseys and shirts are legally purchased directly from official sellers. Jour Couture does not alter or imitate any official team logo or design.

Trademarks, team names and logos, artists, groups, and bands depicted on JourCoutureShop.com belong to the official teams, bands, and artists are purchased from official retailers.

 

DISCLAIMERS
You agree to assume all the risk in using the services and products provided by JourCoutureShop.com and/or Jour Couture. No warranties are provided. The products and content found on this site are provided on an “AS IS” basis without any warranties. This shall constitute a disclaimer of all warranties, including express, implied or statutory warranties. The warranties disclaimed include, but are not limited to, any implied warranties of merchantability, non-infringement, and fitness for a particular purpose. Jour Couture also disclaims warranties concerning the following: (a) the accuracy or reliability of the results that may be obtained from the use of our services or site; (b) errors involving inaccuracy or incompleteness of the site; and (c) the communication of viruses or of anything to cause data corruption, including but not limited to errors, bugs or other problems. No information communicated to you from Jour Couture through this site shall create any warranties of any kind. Jour Couture is not responsible for any damage caused by any links contained on the site.

 

Neither party will be liable for breach-of-contract damages that the breaching party could not reasonably have foreseen when agreeing upon this Terms of Use.

 

DISPUTE RESOLUTION AND MANDATORY ARBITRATION
These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, with no regard to its conflict of law principles. Subject to the arbitration terms found below, any and all legal actions related to, or arising out of, this Agreement and/or the Site or its use, shall be commenced and conducted in Los Angeles County, California, and each user hereby consents to such jurisdiction, including personal jurisdiction.

 

Each party agrees to first provide notice to each other party about any disputes, a thorough description of any problems, and all documents/information related to the problem. If resolution is not reached between the parties within 30 days, the dispute may only be submitted to arbitration. Each party understands they are relinquishing the right to litigate disputes through a court and to have a judge or jury decide the case. Instead, each party chooses to have any disputes resolved through arbitration.

 

Each party agrees that any and all claim or dispute, and any claim by either of us against any agent, employee, director, successor, or assign of the other, including, within the confines of the law, third parties that are not signatories to this agreement, whether related to this agreement or otherwise, including all claims and disputes past, present, and future, and also including any issues as to whether this arbitration clause is valid or applicable, shall only be submitted to binding arbitration administered by the Law.

 

Within the confines as limitations of the law, we each waive any right to institute our claims through class action.

 

ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

 

Our designers select the final shirt to be customized based on order specifications.  The Client is to provide as much information as possible in the order, however, our designers make the final selection of the shirt, jersey, material, and fabric. A design is being ordered, not a specific shirt.
 

GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

For sanitary purposes we do not line the inside bodice with fabric, it comes with the raw finishing on the inside so that you are able to wipe it clean and use again. The material used to create and harden the Jour Couture piece may cause skin irritation. Suggested ways to protect the skin are made available and provided in the FAQ section of the website. We are not liable for any damage to skin or body as a result of wearing or handling our products. We are not responsible or liable for any allergic reactions to our products.

We are not responsible for the user damaging the product by bending, cracking, or placing other items on top or near, or using liquid or chemicals to clean.

Items made with epoxy resin may contain trace amounts of chemicals that could cause skin irritation or allergic reactions in some individuals. Prolonged direct contact with the skin should be avoided for those with sensitive skin or known allergies to epoxy components. Please see FAQ section on ways to wear your Jour Couture piece with a barrier for your skin. If irritation occurs, remove the item immediately and wash the affected area with soap and water. Keep epoxy-based items away from children, and always follow care instructions to ensure safety and longevity of the product.

In no case shall Jour Couture, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SEVERABILITY

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
